Webauthor Software Products and Software-as-a-Service (“SaaS”) Privacy Statement
This Privacy Statement covers the privacy practices that Webauthor employs when providing support, consulting, or hosting services to commercial or non-profit entities and/or individual end users through Webauthor’s Internet based applications, software products and Software-as-a-Service solutions (the “Software Offerings”).
Webauthor.com, LLC (“Webauthor,” the “Company,” “we,” “us,” or “our”) will endeavor to protect and develop or use technology that provides a safe online experience for the customer/consumer (“you” or “your”) and has created this privacy statement (the “Privacy Policy”) to demonstrate its firm commitment to secure and trustworthy Internet commerce and the individual's privacy.
BY USING OUR SOFTWARE OFFERINGS, THIS WEB SITE, AND ANY WEB PAGES AND CONTENT THEREIN (COLLECTIVELY, THE “SITE”), YOU CONSENT TO THE TERMS OF WEBAUTHOR’S PRIVACY POLICY AND TO WEBAUTHOR'S PROCESSING OF PERSONAL INFORMATION FOR THE PURPOSES SET FORTH BELOW.
Registration
You are required to register in order to be granted access to certain information, services and/or products at this Site. At the time of registration, you may be prompted by one of our online forms to provide certain personal information to us, including but not necessarily limited to your name, company name, email address, mobile or other telephone number, and/or credit card information used for billing purposes.
Electronic Communications; Email and Text (SMS) Notifications
BY REGISTERING FOR OR USING A WEBAUTHOR-HOSTED PORTAL OR ANY OF OUR SOFTWARE OFFERINGS, YOU AGREE THAT WE MAY DELIVER NOTICES, DISCLOSURES, AGREEMENTS, AND OTHER COMMUNICATIONS TO YOU ELECTRONICALLY — BY EMAIL AND BY IN-APPLICATION OR PUSH NOTIFICATION — RATHER THAN ON PAPER. You agree that all notices, disclosures, agreements, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. Text (SMS/MMS) messages are not covered by this consent; we send text messages only to users who have separately and expressly opted in to receive them, as described immediately below.
Text (SMS) messaging is separate, express, and optional. We do not obtain consent to send you text messages through this Privacy Policy, through our Terms of Use, or through any other agreement, and consent to receive text messages is never bundled into any other agreement. Consent to receive text messages is not a condition of registering for, purchasing, or using any of our Software Offerings. We send text messages only to users who have affirmatively opted in — by checking the text message consent box presented next to the mobile number field during registration, or by enabling text notifications on the Notification Preferences page in their account profile. Each such box is unchecked by default. When you opt in, we record the date and time of your consent together with the exact disclosure text presented to you at that moment. You may withdraw your consent at any time by replying STOP to any message, by disabling text notifications in your account profile, or by contacting us using the information below. Withdrawing your consent to text messages will not affect your access to the Software Offerings; we will deliver the same notices to you by email or in-application notification instead.
Mobile information and messaging consent are not shared for marketing. No mobile information is shared with third parties or affiliates for marketing or promotional purposes. Specifically, your mobile telephone number, your SMS/text messaging opt-in or consent status, and the contents of messages you exchange with us are never sold, rented, leased, sublicensed, or otherwise disclosed to any third party or affiliate for that party’s own marketing, promotional, or advertising purposes, and are never disclosed to data brokers, lead generators, or advertising networks. Mobile information and messaging consent are disclosed only to the messaging service providers and subcontractors that transmit messages on our behalf, solely for the purpose of delivering the messages you have agreed to receive, and those providers are contractually prohibited from using the information for any other purpose. This paragraph controls over any other provision of this Privacy Policy: nothing elsewhere in this Privacy Policy — including the license granted to Webauthor to use data arising from your use of the Site, or any description of cookies, advertisers, affiliates, or marketing — authorizes the sharing of mobile information or messaging consent in a manner inconsistent with this paragraph.
Account and system notices. Webauthor, and the organization that operates the portal you use, will send you account and system notices at the email address in your account profile, and — only if you have separately opted in to text messaging as described above — at the mobile number in your account profile. These notices are transactional and are part of the service you are requesting. They may include, without limitation: registration confirmations and email or phone verification; one-time passcodes and multi-factor authentication codes; password reset and credential change confirmations; security, fraud, and suspicious-activity alerts; assignment, task, workflow, approval, appointment, case, and enrollment notices; form, submission, and document status updates; expiration, renewal, and deadline reminders; invoice, billing, and payment notices; and planned maintenance, outage, and service-change announcements.
Marketing messages are separate and optional. Consent to receive marketing or promotional email or text messages is separate from the consents described above, is not a condition of registration or of purchasing any product or service, and may be withdrawn at any time without affecting your access to the Software Offerings.
Text message terms. Message frequency varies and depends on your account activity and notification settings. Message and data rates may apply, and you are responsible for any charges imposed by your mobile carrier. To stop receiving text messages, reply STOP to any message you receive from us; reply HELP for assistance, or contact us using the information below. Mobile carriers are not liable for delayed or undelivered messages. You represent that any mobile number you provide is a number you own or are otherwise authorized to use, and that you are authorized to consent to receive messages at that number. You agree to update your account profile promptly if that number changes or is reassigned; until you do, you agree that we may rely on the number in your profile.
Your choices. You may manage your notification preferences, including text messaging, in your account profile at any time, and you may unsubscribe from marketing email using the link included in any such message. Because certain notices are necessary to operate your account and keep it secure — including verification codes, security alerts, legally required notices, and billing notices — we will continue to deliver those notices by email or in-application notification while your account remains active, even if you have opted out of text messaging. You acknowledge that suppressing notices may delay or prevent your receipt of time-sensitive information and may limit your ability to use certain features. To stop all communications, your account must be closed by contacting us or the portal operator.
Requirements and withdrawing consent. To receive electronic communications you need internet access, a current web browser, a valid email address, and — for text messages — a mobile device on a plan that supports SMS/MMS. You may withdraw your consent to receive communications electronically by contacting us, but because the Software Offerings are provided solely by electronic means, doing so will require you to discontinue using them.
Use of Your Personal Information
The personal information that you provide to Webauthor, may be stored, processed, and used by Webauthor and its affiliates for the following purposes: (a) to provide information about our Company, products and/or services, including updates, notifications, and details of any offers or promotions; (b) to assist us in improving our products, services or the content of this Site; (c) to contact you to participate in a market research survey, so that we can gauge customer satisfaction and develop better products; (d) for our own internal marketing and research purposes; (e) to promote user groups; (f) to make our Software Offerings easier to use by eliminating the need for you to repeatedly enter the same information or by customizing our Software Offerings to your particular interests or preferences; (g) to analyze information for trends and statistics; (h) to send you the account, system, and service notices described above by email or in-application notification, and by text message if you have opted in to text messaging. We may also provide this information to an agent acting on Webauthor's behalf in connection with the activities described above.
Webauthor will occasionally hire other companies, which use cookies, to provide limited services on our behalf, such as packaging, sending, and delivering purchases and other mailings; transmitting email, text message, and other notifications; answering customer questions about products or services; processing event registration; or performing statistical analysis of our services. Webauthor will only provide those companies the personal information they need to deliver the service, and those companies are contractually required to use that information solely to perform the service for Webauthor and are prohibited from selling it or using it for their own marketing or promotional purposes.
You also hereby grant to Webauthor a perpetual, non-cancelable, worldwide, non-exclusive right to utilize any data that arises from the use of this Site (or any other Webauthor or its affiliates’ Software Offerings) by you for any legitimate business purpose, including the right to sublicense such data to third parties, subject to all legal restrictions regarding the use and disclosure of such information. Any such use by Webauthor shall provide only non-personally identifiable data and all data will be aggregated in such a way that it cannot be linked to you or your business entity. This grant expressly excludes, and confers no right whatsoever with respect to, mobile telephone numbers, SMS/text messaging opt-in or consent data, and message content, none of which is sublicensed, sold, or shared with third parties or affiliates for marketing or promotional purposes.
Except as described above, Webauthor will not sell, rent, or in any way intentionally disclose personal information that you provide to us on this Site to any third party (other than an agent acting on our behalf as described above), unless: (a) Webauthor is required to do so by law, regulation, warrant, subpoena or court order, (b) Webauthor is required in urgent circumstances to protect the personal safety of Webauthor employees, users of Webauthor products or services, or members of the public, or to enforce provisions of the Terms of Use; or (c) such disclosure is part of a sale or transfer of all (or substantially all) of the assets or stock of Webauthor or one or more divisions or affiliates of Webauthor .
Cookies and Other Information Gathering
Webauthor uses cookies to help us provide better customer service and to enhance the user experience and deliver personalized content. Many improvements and updates to our Software Offerings are based on the data collected through the cookies, such as total number of visitors and pages viewed. A "cookie" is a small text file stored locally in the computer used to access your account, and contains information relating to your past use of this Site. Webauthor may disclose the non-personally identifiable information collected by cookies to third parties including advertisers or potential advertisers. Mobile telephone numbers and SMS/text messaging consent data are never included in any such disclosure and are never shared with advertisers. You have the ability to accept or decline cookies. However, if you choose to decline cookies, you may not be able to fully experience the interactive feature of our Software Offerings or services you visit.
When you browse through any website certain information about your visit can be collected. We automatically collect and temporarily store some or all of these types of information about your visit: domain from which you access the Internet; IP address (an IP or internet protocol address is a number that is automatically given to a computer connected to the Web); operating system on your computer; information about the browser you used when visiting the Site; date and time of your visit; pages you visited; address of the website that connected you to our Software Offerings (such as Google.com or Bing.com). We use this information to track and analyze the number of visitors to our site and to constantly improve its quality. No personally identifiable information is collected by these tools.
Blogs, Bulletin Boards, Webinars, and Chat Rooms
From time to time, portions of this Site may allow you to post information, graphics, or images which other visitors to this Site will be able to access (such as on a “blog”, "bulletin board", “webinar”, or during an interactive audio and/or video "chat" with other visitors). In the event that you choose to post information in this context, it becomes generally available to the public, and we have no ability to control or limit its use by visitors to our site. By posting the information on this Site you are providing Webauthor and its affiliates the right to use the information in connection with the operation of Webauthor's business. Therefore, we encourage you not to post any information you consider private or sensitive on this Site.
Children's Privacy
Webauthor's Site, software and services do not target, and are not structured to attract, children under the age of 13. Webauthor does not collect any registration information from users who indicate they are under the age of 13. If Webauthor discovers personal data from a child, Webauthor will eliminate that data.
Security of Information
To protect the privacy of personal information provided by you, Webauthor and the vendors who may provide hosting services to Webauthor employ industry-standard controls including physical access controls, Internet firewalls, intrusion detection, and network monitoring. Additionally, only authorized administrators and staff have access to systems containing such information. We urge you to take every precaution to protect your personal data when you are on the Internet. Change your passwords often, use a combination of letters and numbers, and make sure you use a secure browser.
Our Software Offerings are designed for users in the United States and Canada. If you access any of our Software Offerings and are a citizen of, or located in, any other country your personal information may be governed by rules or laws that are not known to us. Should that be the case you are prohibited from using our Software Offerings until you have notified us in writing of any such requirements and received a written response from us that we are willing and able to meet those requirements.
Revisions
Webauthor reserves the right to change this Privacy Policy at any time without notice to you, and Webauthor will post any changes to this Privacy Policy on this Site as soon as they go into effect. We encourage you to review the Privacy Policy regularly for any changes.
